Reminder: New employee – not new to public retirement systems

Reminder – CalPERS & CalSTRS New hire does not always mean new to a retirement system Classic vs. PEPRA member
Establishing employees in the correct retirement formula or benefit structure dictates many important factors such as contribution rates, types of compensation subject to retirement, and potential retirement allowance. Adjustments for erroneous reporting are time consuming and can result in fees or penalties and interest. Please use the following guidelines and refer to the examples below for every new hire:
* A new hire does not always mean the employee is a new member of CalPERS or CalSTRS. Districts often hire employees that are already members of CalPERS or CalSTRS.

* CalPERS and CalSTRS have different formulas and benefit structures for retirement coverage that are dependent on specific dates, December 31, 2012 and January 1, 2013. See example below.
* Before adding any new employee into the Escape HR/Payroll modules, always verify retirement membership status and correct formula or benefit structure.

* Log into either CalPERS or CalSTRS software (see examples below) to validate:

* Member, Non-member, New member, or Retiree status. * Already a member – Validate original membership date, ID number, and Classic or PEPRA status. Input or compare this information to what is in the Escape system for correctness. * Non-member – Validate non-member status and monitor hours worked toward mandatory membership. * New member – Input applicable data into the CalPERS or CalSTRS system for membership. Obtain their membership ID number and input the number into the Escape system. * Retiree – All retirees must be identified in CalPERS or CalSTRS as a retiree; update retirement system records if necessary. All retirees must also be identified as a retiree in Escape with Member Type = R. See example below.

* CalSTRS Form ES-0350, Permissive Membership Rev. 04/23<forms.calstrs.com/CalSTRSOnlineFormRequestWebUI/Root/Pages/Order.aspx?usrgrp=SEW&resid=42> * This form should be given to employees (within 10 days of hire date) being hired in certificated positions who are not members of CalSTRS and whose position does not qualify for immediate CalSTRS membership. * The form should be completed by the employee and returned to the employer indicating their acceptance or declining their opportunity for permissive election. Permissive election is irrevocable and results in all future certificated positions being reported to CalSTRS until termination and refund of CalSTRS contributions. * CalSTRS Form ES-0372, Retirement System Election 04/23<forms.calstrs.com/CalSTRSOnlineFormRequestWebUI/Root/Pages/Order.aspx?usrgrp=SEW&resid=42> * This form should be given to employees (within 10 days of hire date) who are members of CalSTRS and have met qualifications in a position for CalPERS membership, or who are CalPERS members who have met qualifications in a position for CalSTRS membership. * It is recommended that districts obtain a written acknowledgement from employees that they have been advised and given Form ES 372 as to their retirement membership rights.

A copy of the form should be provided to the employee, and the original kept in the employee’s personnel file. * Establishing CalPERS reciprocity with another California public retirement system: * To submit a request to establish reciprocity, employees should log in to their myCalPERS<my.calpers.ca.gov/> account and select Retirement, then select Retirement Summary from the drop-down list. Collective Bargaining Agreement & Retroactive Pay, Pay Increases, and Bonuses

Please see below for reminders regarding pay increases, bonuses, and off-salary schedule pensionable compensation.
When a district’s governing board takes action to provide increases to employee benefits or compensation such as salary schedule increases, retroactive cost-of-living-adjustments (COLA), bonuses, or an off-salary-schedule payment, it is important to notify School Business Advisory Services (SBAS).
1. Important reminders:
* Before settling negotiations, please be aware there may be differences in the types of compensation subject to retirement contributions for certificated and classified employees. See the resources below for further guidance. * Obtain necessary board approval before inputting current or retroactive benefit or pay adjustments in Escape. * Districts are responsible for erroneous retirement reporting and may be required to assist with corrections.
1. Notify your District Financial Advisor (DFA) – Submit a Public Disclosure of Proposed Collective Bargaining Agreement (Public Disclosure): Public school districts are required to provide notification of salary settlements to their reviewing agencies and publicly disclose proposed collective bargaining agreements before entering into a written agreement. Please submit your Public Disclosure form to SBAS at least 10-working days prior to the date that the Governing Board will take action on the proposed agreement. During the 10-day window, your DFA will review information in the document for completeness, transparency and reasonableness. For more information and disclosure forms, see Public Disclosure of Proposed Collective Bargaining Agreements – School Business Advisory Services (sbceo.org)<sbasweb.sbceo.org/reporting/public-disclosure-of-proposed-collective-bargaining-agreements>. Welcome Our New SBAS Administrator

We are pleased to announce the selection of Joshua Becerra as SBCEO’s next Administrator, School Business Advisory Services (SBAS). Joshua will begin his new role later this summer.
Joshua currently serves as SBCEO’s Financial Services Manager for Special Education where he develops and maintains the program budget, coordinates payroll and purchasing, and is the fiscal liaison for the program with districts and external agencies. Joshua brings a range of business experience having worked in school/district finance, as well as both public and private accounting. In addition to his work experience, Joshua has a passion for education and is invested professionally and personally in the advancement of the students and families in his community and throughout Santa Barbara County.
Kirsten Escobedo, Associate Superintendent of Special Education, said one of Joshua’s strengths has been his ability to develop and maintain strong relationships with the varied staff with whom he works, including program managers, business officials at SBCEO and other districts, administrative support staff and instructional staff. “In addition, he understands how his work as a business official directly impacts the lives of students in special education. He goes the extra mile to ensure students are provided with the supports they need by prioritizing the work that has the greatest impact on students.”
Escobedo added that Joshua has led important efforts to streamline procedures that have positively impacted teachers. “Josh is a gifted leader, and although we will miss him in the Special Education Division, we are excited that he will continue at SBCEO as Administrator, SBAS.”
Joshua said he is looking forward to supporting the SBAS team, which supports schools and districts in our county with budget management and financial administration. “I’m ready and excited for this new challenge, and to continue my career within the SBCEO family.”
Associate Superintendent, Administrative Services, Steve Torres said Joshua brings to the team both a knowledge of school business as well as a collaborative leadership style. “Joshua involves others in the decision-making process and considers the impact that financial decisions have on districts, their staff, and their students. He is an effective communicator who presents complex budget items in accessible and relevant ways.”
Joshua earned his Bachelor of Science in Accounting from National University and a Master of Public Administration from CSU Dominguez Hills. He resides with his family in Lompoc and enjoys coaching and playing soccer and frequent beach trips with his family.
Through July and August, Joshua will continue as SBCEO’s Fiscal Services Manager for Special Education. Steve Torres will be the point of contact for the Administrator, SBAS, position during the transition.

Reminder: Yearly CalPERS Reporting of Out-of-Class Appointments (due July 30)

Mandatory CalPERS reporting Due July 30 Out-of-Class Appointments
As a reminder, CalPERS requires the online reporting of out-of-class appointment information by July 30. Otherwise, administrative fees and penalties may be assessed. CalPERS requires a response whether or not your district had any employees with an out-of-class appointment. CalPERS mails an annual employer notification of this requirement to school employers at their preferred address in myCalPERS during the month of June.

Please be aware:
* Government Code ยง20480 defines an “out-of-class appointment” to mean an appointment to an upgraded position or higher classification by an employer or governing board or body due to a vacancy for a limited duration. * A “vacant position” refers to a position that is vacant during recruitment for a permanent appointment. * A “vacant position” does not refer to a position that is temporarily available due to another employee’s leave of absence.

STRS Reference Guides pursuant to Education Code section 22325 (Annual Notice)

CalSTRS Annual Notification to Employers of Resources pursuant to Education Code section 22325
In accordance with Education Code section 22325, CalSTRS, at least annually, identifies and provides Resources that interpret and clarify the applicability of creditable compensation and creditable service laws.
Attached are the new reference guides: Creditable Service Reference Guide and a Creditable Compensation Reference Guide.
Three current employer circulars, EIC21-5 Volume 37 Issue 5, EIC21-6 Volume 37 Issue 6, and EIC22-1 Volume 38 Issue 1 will also be designated as Resources.
They are available at www.calstrs.com/calstrs-employer-resources as Resources pursuant to Education Code section 22325.
As a reminder, employers must stay informed of the law, changes in the law, revocations of Resources, new Resources and Resources that supersede a previous Resource.
